In light of Governor Mike DeWine’s executive order temporarily suspending the sale of hemp-derived THC products across Ohio, Fifty West and its Sunflower THC Seltzer brand, the state’s leading THC beverage, are reaffirming their commitment to compliance while voicing concern for Ohio consumers, employees, and the rapidly growing hemp beverage industry. “We respect the intent behind the governor’s action and will fully comply with Ohio law,” said Bobby Slattery, Founder of Fifty West Brewing Company. “But this order feels out of touch with the socially conscious shift we’re seeing in Ohio. People are choosing hemp beverages as safer, more mindful alternatives to alcohol. Pausing an entire industry built around safety and transparency only hurts consumers and jobs.”
What the Suspension Means (and Doesn’t Mean)
- As of October 14, 2025, the retail sale, distribution, and shipment of all hemp-derived THC products, including Sunflower THC Seltzer, must pause.
- Retailers are expected to sell down and remove inventory by October 14.
- The temporary 90-day pause is intended to give Ohio legislators and regulators time to finalize a framework for statewide hemp-THC regulations.
- Consumers who previously purchased hemp-derived products are still legally permitted to possess and consume them. The order applies only to new sales and distribution.
Why This Pause Harms More Than It Helps
- Jobs and Economic Impact
As Ohio’s largest THC beverage producer, Fifty West employs hundreds of people across manufacturing, sales, and hospitality, all supported in some part by this growing category. A statewide freeze threatens those jobs and undermines an industry that is helping bring new life to breweries and beverage manufacturers. - Consumer Choice and Safer Social Options
Thousands of adult Ohioans have embraced hemp-derived beverages as a modern alternative to alcohol. These drinks are lower in calories, hangover-free, and socially responsible options that reflect changing preferences and wellness priorities. - Responsible Companies Already Doing It Right
Sunflower has consistently set the standard for transparency and product safety. As a licensed and regulated manufacturer under the Ohio Department of Agriculture, Fifty West already operates within the state’s food safety framework. Every can of Sunflower contains 5mg THC, is 21+ labeled, and is third-party tested for consistency and quality. These are the same standards Ohio is expected to adopt. - A Missed Opportunity for Partnership
Fifty West supports the creation of a regulated marketplace that keeps products away from minors, ensures companies pay their fair share of taxes, and guarantees consumer safety. Ohio should be working with responsible operators, not against them, to establish science-based standards that protect consumers and support innovation. A collaborative approach would strengthen public confidence and economic growth.
Fifty West’s Commitments During the Pause
- Transparency: Keep partners, employees, and consumers informed about every development.
- Preparation: Continue building inventory, refining processes, and aligning operations with anticipated regulations.
- Advocacy: Engage lawmakers and industry leaders to help craft fair, evidence-based rules that support both safety and growth.
- Education: Provide clear communication to consumers about safe use, legality, and product integrity.
Looking Ahead
“This is a pivotal moment for Ohio,” said Max Fram, Vice President of Strategy and Operations at Fifty West Brewing Company. “We’re proud to have built the state’s leading THC beverage brand right here in Cincinnati, and we’re not slowing down. This pause doesn’t just affect manufacturers like us, it impacts the many retailers, bars, and bottle shops that have embraced this new category and rely on it to serve their communities and support their staff. Partners like Jungle Jim’s, Cappy’s Wine and Spirits, and countless independent stores have invested in these products because they create real opportunity. We believe in regulation. Fair, well-written rules will legitimize this category, keep products safe, and allow responsible companies and local businesses across Ohio to thrive.”
Fifty West remains optimistic that clear, consistent rules will emerge from this pause—rules that protect consumers, preserve innovation, and recognize the shifting ways people choose to unwind responsibly.
